1. Introduction

Welcome to Key Racer! These Terms and Conditions ("Terms") govern your access to and use of the Key Racer typing application (the "Service"), including any content, functionality, and services offered through keyracer.com or our application interfaces.

Please read these Terms carefully before using our Service. By accessing or using Key Racer, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our Service.

2. Eligibility

To use Key Racer, you must be at least 13 years of age. By using our Service, you represent and warrant that:

• You are at least 13 years old.
• You have the legal capacity to enter into these Terms.
• You agree to comply with these Terms and all applicable local, state, national, and international laws, rules, and regulations.

If you are using the Service on behalf of a business or organization, you represent and warrant that you have the authority to bind that organization to these Terms, and you agree to be bound by these Terms on behalf of that organization.

3. User Accounts

3.1 Account Creation

To access certain features of Key Racer, you may need to create a user account. When creating an account, you must provide accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2 Account Security

You agree to:

• Create a strong password and keep it confidential.
• Notify us immediately of any unauthorized access to or use of your account.
• Ensure that you log out from your account at the end of each session when using a shared device.

3.3 Account Termination

We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of the Service, us, or third parties, or for any other reason.

4. User Conduct

While using Key Racer, you agree not to:

• Use the Service in any way that violates any applicable law or regulation.
• Impersonate or attempt to impersonate Key Racer, a Key Racer employee, another user, or any other person or entity.
• Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service.
• Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service, the server on which the Service is stored, or any server, computer, or database connected to the Service.
• Attack the Service via a denial-of-service attack or a distributed denial-of-service attack.
• Use any robot, spider, or other automatic device, process, or means to access the Service for any purpose, including monitoring or copying any of the material on the Service.
• Introduce any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.

5. Intellectual Property Rights

5.1 Service Content

The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Key Racer, its licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

5.2 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Service for your personal, non-commercial use. This license does not include:

• The right to reproduce, distribute, modify, or create derivative works of the Service or its content.
• Any resale or commercial use of the Service or its contents.
• Any collection and use of any product listings, descriptions, or prices.
• Any use of data mining, robots, or similar data gathering and extraction tools.
• Downloading (other than page caching) of any portion of the Service or its content except as expressly permitted by us.

5.3 Trademarks

The Key Racer name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Key Racer or its affiliates or licensors. You may not use such marks without our prior written permission. All other names, logos, product and service names, designs, and slogans on the Service are the trademarks of their respective owners.

6. User-Generated Content

6.1 User Contributions

The Service may contain message boards, chat rooms, personal profiles, forums, or other interactive features (collectively, "Interactive Services") that allow users to post, submit, publish, display, or transmit content or materials (collectively, "User Contributions") on or through the Service.

6.2 License to User Contributions

By providing any User Contribution on the Service, you grant us and our affiliates and service providers, and each of their and our respective licensees, successors, and assigns, a non-exclusive, perpetual, irrevocable, royalty-free, worldwide license to use, reproduce, modify, perform, display, distribute, and otherwise disclose to third parties any such material for any purpose.

You represent and warrant that:

• You own or control all rights in and to your User Contributions and have the right to grant the license granted above.
• All of your User Contributions comply with these Terms.
• Your User Contributions do not violate the rights of any third party, including copyright, trademark, privacy, or other personal or proprietary rights.

7. Monitoring and Enforcement

We have the right to:

• Remove or refuse to post any User Contributions for any reason at our sole discretion.
• Take any action with respect to any User Contribution that we deem necessary or appropriate, including if we believe that such User Contribution violates these Terms, infringes any intellectual property right or other right, threatens the personal safety of users of the Service or the public, or could create liability for us.
• Disclose your identity or other information about you to any third party who claims that material posted by you violates their rights, including their intellectual property rights or their right to privacy.
• Take appropriate legal action, including without limitation, referral to law enforcement, for any illegal or unauthorized use of the Service.
• Terminate or suspend your access to all or part of the Service for any violation of these Terms.

Key Racer may display advertisements and promotions from third parties on the Service. Your interactions with advertisers are solely between you and the advertiser. We are not responsible or liable for any loss or damage of any kind incurred as a result of any such dealings or as a result of the presence of such advertisers on the Service.

The Service may contain links to third-party websites, resources, or services. We provide these links only as a convenience and are not responsible for the content, products, or services on or available from those websites or resources. We have no control over the contents of those sites or resources and accept no responsibility for them or for any loss or damage that may arise from your use of them.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER KEY RACER NOR ANY PERSON ASSOCIATED WITH KEY RACER MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SERVICE.

WITHOUT LIMITING THE FOREGOING, NEITHER KEY RACER NOR ANYONE ASSOCIATED WITH KEY RACER REPRESENTS OR WARRANTS THAT THE SERVICE WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT THE SERVICE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT THE SERVICE WILL OTHERWISE MEET YOUR NEEDS OR EXPECTATIONS.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL KEY RACER, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICE, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE SERVICE OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

11. Indemnification

You agree to defend, indemnify, and hold harmless Key Racer, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including, but not limited to, your User Contributions, any use of the Service's content, services, and products other than as expressly authorized in these Terms.

12. Changes to the Terms

We may revise and update these Terms from time to time at our sole discretion. All changes are effective immediately when we post them and apply to all access to and use of the Service thereafter. Your continued use of the Service following the posting of revised Terms means that you accept and agree to the changes.

13. Governing Law and Jurisdiction

No waiver by Key Racer of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Key Racer to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
